These terms are the agreement between you and FamFrame. The short version: be 16 or over; the people and photos you upload are yours (you give us permission to display them so the app works); the frames you make are yours to keep; frame credits are non-refundable digital goods sold by FamFrame through LemonSqueezy; don’t use the app for illegal, abusive, or harmful things; we can suspend accounts that do. The longer version follows.
1. The agreement
These Terms of Service (the “Terms”) form a binding agreement between you and Alon Mittelman, trading as Mimona Technologies, a sole proprietor registered with the Israeli Tax Authority under the Osek Patur regime, registration number 300171220, with a place of business at 24 Hertzl Street, Ramat Gan, Israel (“FamFrame”, “we”, or “us”). By creating an account or using FamFrame you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy.
If you do not agree, do not use the service.
2. The service
FamFrame is a web application for drawing a small visual map of your family and making heirloom-style frames from the moments that matter to you. The service is provided as a hosted online product; we may change, improve, or remove features from time to time and will try to give reasonable notice of material changes.
3. Eligibility
FamFrame is for people aged 16 and over. By creating an account you confirm that you are at least 16. If you are using FamFrame on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms; the entity is then jointly responsible with you for compliance.
4. Your account
Sign-in is by emailed magic link or Google OAuth. You are responsible for keeping access to your email or Google account secure; anyone who controls that email or Google account will be able to sign in to your FamFrame account. If you suspect unauthorised access, write to us at admin@thebaio.com immediately.
Keep your account information accurate. One account per person. You may not transfer your account to anyone else.
5. Your content
“Your Content” means everything you add to FamFrame: the people you create, their bios and memories, the photographs you upload, the frames you compose, and any other material you submit. You keep ownership of Your Content. We do not claim copyright in your photographs, your writing, or the frames you make.
So that we can actually run the service, you grant FamFrame a worldwide, royalty-free, non-exclusive licence to host, copy, store, display, transmit, and create technical derivatives of Your Content for the limited purposes of operating, securing, maintaining, and improving FamFrame, and of providing the service to you. The licence ends when you delete the content or your account, except (a) for copies retained in routine backups for the period described in our Privacy Policy, and (b) where retention is required by law.
You confirm and warrant that you have all rights necessary to upload Your Content to FamFrame, including the right to upload photographs of any person depicted in them, and that Your Content does not infringe the rights of any third party. If a third party has a valid objection to your use of their image, write to admin@thebaio.com and we will remove it. You are responsible for Your Content.
Reporting infringing or unauthorised content. If you believe content on FamFrame infringes your copyright or uses your image without permission, write to admin@thebaio.com with enough detail to identify the content and your rights in it, and a statement that your complaint is made in good faith. We will review every notice, remove content that we determine to be infringing or unauthorised, and may suspend repeat infringers. We will not charge you to make such a request.
6. The frames you make
Frames you make on FamFrame are yours to keep for personal and family use, to download, to print, and to share with people who matter to you. You may not resell frames, claim them as commercial stock imagery, or use them in a way that misrepresents real people or events.
7. Frame credits and purchases
Making a frame costs frame credits. New accounts start with a small complimentary balance. Additional credits can be purchased through the in-app purchase flow.
Merchant of record. Purchases are processed by LemonSqueezy, which acts as the seller of record and is responsible for collecting payment and applicable VAT or sales tax. LemonSqueezy’s own terms apply to the payment transaction; the digital content (frame credits and the frames you spend them on) is provided by FamFrame under these Terms.
Price and taxes. Prices shown in the app are exclusive of taxes unless otherwise stated. LemonSqueezy will add applicable taxes at checkout.
Delivery. Credits are added to your balance immediately on successful payment confirmation. By starting the purchase you expressly request that we begin delivering the digital content immediately and acknowledge that, to the extent permitted by Section 14C(d) of the Israeli Consumer Protection Law, 5741-1981, and Article 16(m) of the EU Consumer Rights Directive 2011/83/EU, this causes you to lose the statutory right of withdrawal once delivery has begun.
No refunds for used credits. Credits, once spent on a frame, are not refundable. Unused credits remain on your account for as long as your account is active and are not redeemable for cash. If a frame fails to make for reasons attributable to us (for example, a server error), we will refund the credits used to your balance.
Using credits is at your discretion. Spending credits is your choice. Because frames are artistic interpretations (see the Disclaimers section below), a result you are not satisfied with — including how closely a frame resembles a person — is not by itself a fault in the service and does not entitle you to a refund of the credits spent. This does not affect the refund for technical failures attributable to us described above, nor your non-waivable rights under mandatory consumer-protection law.
Statutory remedies. Nothing in this section limits the rights you may have under mandatory consumer-protection law, including the EU Digital Content Directive 2019/770 and the Israeli Consumer Protection Law 5741-1981. If you believe the service does not conform to what was promised, write to admin@thebaio.com and we will work with you to put it right.
8. Acceptable use
You agree that you will not:
- Upload photographs or other content of a person without that person’s knowledge and (where required) consent.
- Upload content that is illegal, defamatory, harassing, hateful, sexually explicit, sexualising any minor, or that infringes another person’s rights.
- Attempt to gain unauthorised access to FamFrame, any other user’s account, or our infrastructure; reverse engineer the service except to the limited extent permitted by law; or use the service to send malware.
- Scrape, copy, or otherwise extract large portions of the service or its content, or use automated means to register accounts or generate frames.
- Use FamFrame to impersonate another person or to create a misleading record of a real family or person.
- Resell access to FamFrame, sublicense your account, or use the service to provide a competing product.
- Use the face or likeness features to create images intended to deceive, defame, harass, or portray a real person in a false, misleading, or harmful light; to depict any person in a sexual or intimate context; or to create non-consensual imagery of any person.
- Upload the likeness of, or make frames depicting, a public figure or any other person who has not consented, where doing so is intended to mislead others or could harm that person.
We may suspend or terminate any account that we reasonably believe is in serious or repeated breach of this section, as set out in Section 12 below.
9. Our intellectual property
FamFrame, its name, design language (including the hand-drawn rough.js visuals), the underlying software, the database structure, and all related materials are owned by us or licensed to us. We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use FamFrame for the purposes described in these Terms. No other rights are granted.
10. Availability and changes
FamFrame is provided on an “as available” basis. We aim to keep the service up and the data safe, but we cannot guarantee uninterrupted availability, that the service will be free of bugs, or that any particular feature will be preserved. We may modify, suspend, or discontinue any part of the service at any time. For material changes that affect paid features we will give reasonable advance notice.
11. Third-party services
FamFrame relies on third-party services (listed in our Privacy Policy). We are not responsible for the acts or omissions of those third parties beyond our duty to choose and supervise them with reasonable care.
12. Suspension and termination
You can stop using FamFrame at any time and delete your account from the settings page once that feature ships. We may suspend or terminate your account, with or without notice, if (a) you materially breach these Terms or the acceptable-use rules above, (b) we are required to do so by law or by a binding legal request, (c) your continued use poses a security risk to FamFrame or to other users, or (d) we discontinue the service in your jurisdiction. Where we can give notice without compromising legal or security interests, we will.
Termination ends your licence to use the service. Sections 5 (warranties about Your Content), 7 (paid amounts already due), 13–17, and any provision that by its nature should survive, survive termination.
13. Disclaimers
Except where mandatory law (including the EU Digital Content Directive 2019/770 and the Israeli Consumer Protection Law 5741-1981) provides otherwise and to the extent permitted by law, FamFrame is provided on an “as is” and “as available” basis. We do not give any implied warranty of merchantability, fitness for a particular purpose, or non-infringement beyond what mandatory law requires.
Likeness is not guaranteed. Frames are artistic interpretations created from the photos you provide. We do not warrant that any frame will be an exact, accurate, or recognisable likeness of any person, that a person’s appearance will be consistent between frames, or that a frame will meet your expectations. This does not remove any non-waivable rights you may have as a consumer under applicable law.
14. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct, or for any other liability that cannot be limited or excluded under applicable law. Where you act as a consumer and the law of your country of habitual residence gives you non-waivable rights, those rights are unaffected by these Terms.
Subject to the paragraph above, to the maximum extent permitted by applicable law, our aggregate liability to you for all claims arising out of or in connection with FamFrame and these Terms is limited to the greater of (a) the amount you paid to LemonSqueezy for frame credits in the twelve (12) months immediately preceding the event giving rise to the claim, and (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of data, profits, revenue, goodwill, or expected savings, to the extent permitted by law.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold FamFrame harmless from any third-party claim, liability, or expense (including reasonable legal fees) arising from (a) Your Content, (b) your breach of these Terms, or (c) your violation of any law or the rights of any third party. This section does not apply where you act as a consumer and applicable consumer-protection law makes the indemnity unenforceable.
16. Governing law and where disputes are heard
These Terms and any dispute arising out of them are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of Tel Aviv–Yafo, Israel have exclusive jurisdiction over any dispute.
If you act as a consumer and the law of your country of habitual residence (for example, in the EU/EEA, the UK, or California) gives you the right to bring proceedings in the courts of that country and to rely on the consumer-protection law there, nothing in this section deprives you of that right.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top, and for material changes we will give you notice in the app or by email before the change takes effect. If you keep using FamFrame after the change you accept the updated Terms; if you do not accept them, please stop using the service and write to us if you wish to delete your account.
18. Miscellaneous
These Terms (with the Privacy Policy) are the entire agreement between us about FamFrame. If any provision is held unenforceable, the rest of the Terms remain in force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them as part of a business transfer or to a successor operator on the same terms.
Events beyond our control. We are not liable for any delay or failure to provide FamFrame caused by events beyond our reasonable control — including outages of the hosting, storage, email, or image-processing providers we rely on, network failures, or other force majeure — beyond what mandatory law requires. Notices. We give you notices in the app or by email to the address on your account; you give us notices at the contact address below.
